Terms of Service for Bharse Security Scanner

1. Acceptance of Terms

By installing and using Bharse Security Scanner ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not install or use the App.

2. Description of Service

Bharse Security Scanner provides automated security scanning and vulnerability detection for Shopify stores. The service includes:

• Automated security scans
• Theme code analysis
• App permission auditing
• Security scoring and reporting
• Scan history and trend analysis

3. Subscription and Billing

3.1 Plans

• Free Plan: $0/month - 1 scan per month
• Professional Plan: $9/month - 10 scans per month
• Enterprise Plan: $99/month - Unlimited scans

3.2 Billing

• All paid plans are billed through Shopify
• Subscriptions renew automatically monthly
• Prices are in USD unless otherwise stated
• 14-day free trial available on paid plans

3.3 Refunds

• Refunds are handled according to Shopify's refund policy
• No refunds for partial months
• Cancel anytime through Shopify admin

4. User Obligations

You agree to:

• Provide accurate store information
• Use the App in compliance with all applicable laws
• Not attempt to reverse engineer or hack the App
• Not use the App for illegal or unauthorized purposes
• Maintain the security of your Shopify account

5. Acceptable Use

You may not:

• Share your account with unauthorized users
• Use the App to scan stores you don't own or manage
• Attempt to overwhelm the service (DoS attacks)
• Use scan results to harm other parties
• Violate any third-party rights

6. Intellectual Property

6.1 Our Rights

• The App, its code, design, and content are our property
• Our trademarks and logos may not be used without permission
• All scan algorithms and methodologies are proprietary

6.2 Your Rights

• You own your store data and scan results
• You may export and use scan results as you wish
• You grant us permission to access your store for scanning purposes

7. Disclaimers and Limitations

7.1 Service "As Is"

The App is provided "as is" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

7.2 Security Findings

• Scan results are informational and advisory only
• We do not guarantee detection of all vulnerabilities
• You are responsible for implementing security fixes
• We are not liable for security breaches or data loss

7.3 Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the last 12 months
• We are not responsible for third-party actions or services

8. Service Availability

8.1 Uptime

• We strive for 99.9% uptime (Enterprise plan)
• Planned maintenance will be announced in advance
• We are not liable for service interruptions

8.2 Service Changes

We reserve the right to:

• Modify features or functionality
• Update pricing with 30 days notice
• Discontinue the service with 90 days notice

9. Data and Privacy

• Your use of the App is governed by our Privacy Policy
• We implement security best practices
• You are responsible for backing up your own data
• We may delete data according to our retention policies

10. Termination

10.1 By You

• You may cancel your subscription anytime through Shopify
• Cancellation takes effect at the end of the billing period
• Scan history may be deleted after cancellation

10.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay subscription fees
• Use the service in a harmful manner

10.3 Effect of Termination

Upon termination:

• Access to the App is revoked immediately
• Scan data is retained according to our data retention policy
• No refunds for unused time

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law provisions.

12.2 Arbitration

Any disputes shall be resolved through binding arbitration, except:

• Small claims court actions

Continued use of the App after changes constitutes acceptance.
